Nxjerrja e akteve n\u00ebnligjore p\u00ebr pakicat bazohet n\u00eb dispozitat e ligjit nr. 96\/2017 \u201cP\u00ebr mbrojtjen e Pakicave Komb\u00ebtare n\u00eb RSH-s\u00eb\u201d dhe detyrimet q\u00eb rrjedhin nga Konventa Kuad\u00ebr e K\u00ebshillit t\u00eb Evrop\u00ebs p\u00ebr Mbrojtjen e Pakicave Komb\u00ebtare\u201d. Ky ligj dhe kuadri n\u00ebnligjor n\u00eb zbatim t\u00eb tij parashikojn\u00eb dispozita p\u00ebr zbatimin e t\u00eb drejtave specifike t\u00eb pakicave komb\u00ebtare: vet\u00eb-identifikimi, mos diskriminimi, t\u00eb drejtat arsimore, kulturore, ruajtja dhe zhvillimi i identitetit t\u00eb tyre, p\u00ebrfaq\u00ebsimi n\u00eb jet\u00ebn ekonomike, sociale, publike, etj, krijimin e kushteve dhe mund\u00ebsive p\u00ebr ushtrimin e t\u00eb drejtave specifike lidhur me p\u00ebrdorimin e gjuh\u00ebs s\u00eb pakicave n\u00eb marr\u00ebdh\u00ebniet me autoritetet, p\u00ebrdorimin e emrave, mbiemrave, treguesit topografik\u00eb n\u00eb gjuh\u00ebn e pakicave komb\u00ebtare, mekanizmin institucional p\u00ebr p\u00ebrfaq\u00ebsimin e pakicave dhe forcimin e rolit dhe kompetencave t\u00eb Komitetit t\u00eb Pakicave Komb\u00ebtare;<\/span><\/p>\n

Q\u00eb prej 13 Korrikut t\u00eb vitit 1995, Shqip\u00ebria \u00ebsht\u00eb vend an\u00ebtar i K\u00ebshillit t\u00eb Europ\u00ebs. Nj\u00eb akt shum\u00eb i r\u00ebnd\u00ebsish\u00ebm, p\u00ebr njohjen dhe mbrojtjen e t\u00eb drejtave t\u00eb pakicave \u00ebsht\u00eb Konventa Kuad\u00ebr e K\u00ebshillit t\u00eb Europ\u00ebs \u201cP\u00ebr mbrojtjen e pakicave komb\u00ebtare\u201d.<\/strong><\/span><\/p>\n

Krijimin e Fondit p\u00ebr Pakicat Komb\u00ebtare p\u00ebr mb\u00ebshtetjen e nismave dhe projekteve q\u00eb synojn\u00eb mbrojtjen e t\u00eb drejtave t\u00eb pakicave komb\u00ebtare, ruajtjen dhe promovimin e identitetit t\u00eb tyre t\u00eb dalluesh\u00ebm kulturor, etnik, gjuh\u00ebsor, tradicional dhe fetar t\u00eb pakicave komb\u00ebtare. Miratimi akteve n\u00ebnligjore p\u00ebr zbatimin e k\u00ebtij ligji ve\u00e7an\u00ebrisht p\u00ebr sa i takon mbledhjes s\u00eb t\u00eb dh\u00ebnave, arsimit, p\u00ebrdorimit t\u00eb gjuh\u00ebs n\u00eb marr\u00ebdh\u00ebniet me autoritetet administrative, bazohet n\u00eb kriteret objektive dhe kriterin subjektiv (parimi i vet\u00eb-identifikimit), si\u00eb parashikohet edhe nga ligji nr.96\/2017 mbi pakicat komb\u00ebtare dhe kriteret e parashikuara nga Konventa Kuad\u00ebr p\u00ebr Mbrojtjen e Pakicave Komb\u00ebtare. Zgjedhja subjektive individuale \u00ebsht\u00eb e lidhur me kriterin objektiv p\u00ebrkat\u00ebs t\u00eb identitetit t\u00eb personit (neni 3 i Konvent\u00ebs Kuad\u00ebr).<\/span><\/p>\n
